California considers requiring motorcycle smog checks

Alright ~ here's a question for ya... Harley sells AND installs Screamin' Eagle exhaust on stage I and II set-ups. Now, will they meet emission std's or will they have to be replaced with OEM exhaust??? Now, they were legal to sell, install and run in the current and past... I smell attorneys.
I cannot believe the motorcycle population in CA produces more NOx than all the diesel p/u, suv, motorhomes, etc, etc. Sounds to me like you folks in CA have a senator that needs to be taken to task.
Everyone want to drive a Prius? Oh ~ just to let you know ~ it's proven through research that most smaller diesel engine cars produce a smaller carbon footprint than a Hybrid... next will be bio-fuel for your bike... oh yeah ~ that produces more NOx too... damn!!!

IF YOU THINK THIS IS NOT OUR CONCERN--YOU ARE WRONG!! IT WILL SET PRECEDENT!

Motorcycle Riders....Please forward this info to EVERYONE on your email list....IMMEDIATELY!!

DEAD DATE: Monday June 28, 2010.

Senate Bill 435, (Pavley) the Smog Check for Motorcycles Bill - has MORPHED into a NO AFTERMARKET EXHAUST Bill.

In other words...sticker matching. The EPA mandated sticker on your frame, must match the EPA mandated engraving on your stock exhaust pipes or...at-DA...TICKET.

SEE THE BILL: http://leginfo.ca.gov/pub/09-10/bill/sen/sb_0401-0450/sb_435_bill_20100615_amended_asm_v94.html

The Bikers of California must mobilize FASTER than they've ever done before.

YOUR efforts against the previous "Smog Check for Motorcycles" version of this bill have forced the author of SB 435 to change tactics - and try to further restrict your enjoyment of motorcycling in a far more clever, potentially catastrophic way, through the back door - under cover of darkness. Nice, huh? Get all your riding friends and the shops you visit to get involved NOW!

If SB 435 is signed into law, SMOG CHECK FOR MOTORCYCLES could be EVEN EASIER to pass in the NEXT legislative session. Do NOT let this happen to the sport you love!

WE MUST STOP BOTH, NO AFTERMARKET EXHAUST SYSTEMS and SMOG CHECK FOR MOTORCYCLES - NOW!

We do that by shutting down SB 435 in the Assembly Transportation Committee on Monday, June 28, 2010.

 ***ACTION***

You MUST contact your state legislators IMMEDIATELY. ESPECIALLY if YOUR state legislator sits on the Assembly Transportation Committee. (See list below)

You must call, write, email, text, FAX and visit your legislators RIGHT NOW. You have no time to waste. Talk to their "Chief of Staff"...that works, too.

 ***WHO IS MY LEGISLATOR***

FIND your legislator: http://www.leginfo.ca.gov/yourleg.html

You have ONE State Assemblyperson and ONE State Senator.

Californians are represented by 40 Senate Members (4 year terms, limit of 2 terms) and 80 Assembly Members (2 year terms, limit of 3 terms)

***WHAT DO I SAY?***

"My name is ______________ and I'm calling to ask Assemblyperson ___________ to PLEASE vote "NO" on SB 435 (Pavley). Thank you"

 It's that easy!!

Be polite, kind and respectful, or don't bother. Remember, YOU represent ALL of us, don't mess it up for Bikerdom.

Talking points are available from ABATE of CA, here: http://www.abate.org/IssuesLegislation/CurrentIssuesLegislation.aspx
A PRINTABLE info sheet produced by ABATE of CA for motorcycle shops is available here: http://www.abate.org/LinkClick.aspx?fileticket=gr3b6mgeDjM%3d&tabid=73

***PLEASE***
Remember - YOU represent ALL motorcyclists when you call.

PLEASE do NOT embarrass us.

Be respectful and polite or don't bother.

Don't trust this to somebody else, take responsibility for YOUR rights, TODAY!

***BY WHEN?***

Our DROP DEAD date is Monday June 28, 2010 when the Bill is scheduled to be heard in the Assembly Transportation Committee.

If you wait, they'll walk right in and strike a blow against motorcycling. Your aftermarket exhaust system could become ILLEGAL.
If you want a job done right, do it yourself. We must DOMINATE their phone lines and emails.
Don't let this bill reach the floor, kill it in committee.

Call or FAX these members of the California Assembly Transportation Committee

* indicates a key vote, if you're in one of these districts please make a special effort to contact your Assemblymember.

All bikes in the UK have to abide with emissions tests.

According to ABATE... The wording in the new proposal has eliminated "Smog Checks" and would only require EPA exhaust labels on bikes manufactured after January 1, 2011. However, because of existing "Exhaust tampering" laws already in place they might have a loophole to still gig us on. Sad thing is, no matter what legislation is passed, their gonna do whatever they want !!!!

“The noise caused by illegally modified motorcycle exhaust systems is a major quality of life issue across the state,” said Senator Pavley. “Basic common sense and decency dictates that when a motorcycle drives by and sets off every car alarm on the street, that is too loud. Additionally, many of the modifications which are aimed at making a bike louder - for example removing the catalytic converter - also make the bike exponentially more polluting. This has direct, measurable and negative impacts on public health.”

The past decade has seen improvements in pollution control equipment for motorcycles, and most now come equipped with catalytic converters and other emissions control devices. “However, many motorcycle enthusiasts remove the factory installed emissions control equipment and replace it with custom parts that create an exponentially higher amount of noise and air pollution than the factory kits, or legal aftermarket replacements,” said Senator Pavley.

This bill will apply to motorcycles and aftermarket parts going forward from 2013.

Just saw this thought I would share with the rest of you.  Was not sure if you knew about this action or if it was from the closed door policys and money changeing hands.

Yet another reason I will not live in Ca., however this kind of over-involvement of government does or should indeed concern us all.
"We the People" need to stand up again, get involved, voice our position and get rid of those politicians that would infringe on our freedoms and rights – enough is enough!
I don't know about all areas of the country, but I do know that in pretty much all the areas I have ridden and traveled through, few if any had "motorcycle only" parking spaces.  Anyone see any biker only lanes anywhere?
Yet with most bikes ranging from 40-60 mpg are they not more "green" than most of the cars?
As for the loud exhaust...maybe if the cage drivers paid more attention to what was going on outside of their Crackberry texting, or make-up applying mirror watchers, non-signaling lane drifters...maybe we could feel safer riding the whisper machines (though I personally like the sound of the big twin growl) – how about spending more time picking on these moving threats to everyone?
The bottom line seems to be all about money making for the State and Fed…imagine that – now it’s our turn to start pushing back and demanding we keep our money, our rights and our freedom. They can keep the change.
My rant for the day…
